(c) "Workr" mans a czn of V Nam who s n h procss of nrng no or has nr no a conrac o work n Malaysa for a spcf pro of m, as spula n h Conrac of Employmn, bu os no nclu omsc workrs as fn n h Employmn Ac 1955 [Ac 265] of Malaysa;

() "Malaysan Rcrumn Agncy" (MRA) mans a prva mploymn agncy lcns unr h Prva Employmn Agncy Ac 1981 an approv by h Govrnmn of Malaysa for h purpos of rcrung Workrs; an

() "V Nam Rcrumn Agncy" (VRA) mans an nrprs lcns unr h Law on Vnams Workrs Workng

CONTRACT OF EMPLOYMENT

2. Any amnmns o h rms an conons of h Conrac of Employmn ma by h Jon Workng Group unr APPENDIX C shall no affc or nvala any xsng Conrac of Employmn n forc bwn h Employr an h Workr.

3. In h vn of oal closur or cas of busnss or wnng up, h Workr shall hav h opporuny o chang h mployr whn h sam scor, upon h approval of h rlvan auhors an subjc o laws an rgulaons n Malaysa.

4. Th Workr may hav an opporuny o chang h Employr, n cas of xploaon, abus, physcal an mnal harassmn subjc o omsc laws an rgulaons as rmn by h compn auhors.

ARTICLE 6

RECRUITMENT, SAFETY AND SECURITY OF WORKERS

1. Th GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM shall nsur ha h Workr who s slc for mploymn by h Employr shall fulfl h followng conons pror o hs/hr nry no Malaysa:

PERIOD OF EMPLOYMENT

ARTICLE 8

RESPONSIBILITIES

ARTICLE 9

REPATRIATION

Th Pars shall facla h rparaon of Workr upon h rmnaon of hs/hr Conrac of Employmn unr APPENDIX A of hs MoU.

ARTICLE 10

JOINT WORKING GROUP

ARTICLE 11

FINANCIAL ARRANGEMENTS

ARTICLE 12

REVISION MODIFICATION AND ADMENDMENT

ARTICLE 13

SUSPENSION

SETTLEMENT OF DISPUTES

Any ffrnc or spu bwn h Pars concrnng h nrpraon or mplmnaon or applcaon of any of h provsons of hs MoU shall b sl amcably hrough muual consulaon or ngoaons bwn h Pars hrough plomac channls, whou rfrnc o any hr pary or nrnaonal rbunal.
